These comprehensive Terms of Use (hereinafter referred to as the "Terms") govern all aspects of your access to, interaction with, and utilization of the School platform (hereinafter referred to as the "Application"), which is exclusively owned, developed, maintained, and operated by SchoolPad Technologies Private Limited (hereinafter referred to as "SchoolPad" or "we" or "us" or "our"), a company duly incorporated under the laws of India with Corporate Identification Number (CIN): U72900PB2013PTC037604, having its registered office at SCO 46, Sector 80, SAS Nagar, Mohali, Punjab – 160062, India. SchoolPad has been at the forefront of educational technology innovation in India.
By accessing, registering for, logging in, signing up, or utilizing the Application and/or its associated services in any manner whatsoever, you hereby acknowledge, understand, and unequivocally agree to be legally bound by these Terms.
These Terms comprehensively govern all interactions, transactions, and relationships between SchoolPad and its diverse user base, which includes school staff members, students, parents, and authorized representatives designated by the school that has signed up with SchoolPad (collectively referred to as ‘Users’ or ‘you’ or ‘your’) who engage with our platform.
Our Privacy Commitment
At SchoolPad, your privacy is a priority. We have never sold your information for advertising purposes, nor have we profited by showing you third-party advertisements—and we never will. This has been our unwavering commitment since our inception over a decade ago, and it continues to guide how we build and operate our services.
We record the IP address of users at the time of login for security, audit, and legal compliance purposes. Such information is stored securely and retained only for as long as necessary to meet these purposes or as required by applicable law.
1. Application Overview and Intended Use
1.1 Purpose
The Application is a cloud-based school management platform designed to assist educational institutions in managing administrative operations and communication with students, parents, and staff. It provides a secure, organized, and efficient system for storing, processing, and sharing institutional information. The Application is maintained and updated by SchoolPad Technologies to meet the operational and compliance needs of educational institutions.
1.2 Scope of Features
The Application’s features include, without limitation:
- Secure access controls for student and parent profiles;
- Automated attendance tracking with accuracy and audit capability;
- Management of institutional processes such as transport schedules, fee collection, and other school-related financial or logistical functions;
- Dissemination of official communications, including notices, circulars, and important updates;
- Sharing of school event media, including photographs, videos, and related content;
- Academic communication tools, including secure access to performance records, reports, and updates through a user-friendly interface.
These features are provided to facilitate institutional management and user communication and shall not be interpreted as extending to purposes beyond those expressly stated.
1.3 Centralized Information Hub
The Application serves as a centralized digital hub for schools to store, organize, and disseminate institutional data, ensuring timely and controlled access for authorized users.
1.4 Role-Based Access Controls
The Application incorporates role-based permission settings, enabling each institution to define which Users may view, upload, modify, or delete information. The educational institution is solely responsible for assigning, monitoring, and updating such permissions to safeguard data accuracy, integrity, and confidentiality.
1.5 Intended Use and Limitations
The Application is intended strictly for school administration and communication purposes. It is not designed or intended to:
- Deliver or administer official examination materials;
- Conduct proctored or high-stakes examinations;
- Perform formal academic assessments or certifications;
- Generate, file, or submit statutory or regulatory reports unless expressly provided in writing;
- Act as the sole or authoritative record for compliance, finance, or regulatory purposes;
- Provide legal, regulatory, or policy advice;
- Monitor or assume responsibility for the conduct or behaviour of students, staff, or other users;
- Function as a complete accounting, taxation, or compliance system;
- Store, process, or transmit categories of data prohibited under applicable Indian laws or institutional policies.
1.6 Academic and Co-Curricular Features
Features related to academic or co-curricular activities (including homework, projects, assignments, and seminars) are intended solely for communication, scheduling, and tracking. They do not constitute formal evaluation, certification, or grading mechanisms.
1.7 User Understanding
Users acknowledge and agree that they shall use the Application strictly within the scope defined in this Section. The Application must not be used in any manner inconsistent with its intended purposes, or in contravention of applicable laws, regulations, authority guidelines, or school policies.
2. Data Protection and Privacy
2.1 Role in Data Processing
The educational institution acts as the Data Fiduciary for all personal information collected through the software. SchoolPad’s role is that of a Data Processor, processing personal data only on documented instructions from the educational institution, in accordance with applicable law and the terms of this agreement.
2.3 Responsibility for Collection and Consent
- Determining what personal data is collected;
- Obtaining any required consents from users or, where applicable, their legal guardians;
- Ensuring that all data collection complies with applicable data protection laws and institutional policies.
2.4 Processing of Sensitive Information
Where the institution chooses to collect sensitive personal data (such as health-related information, including medical conditions, allergies, or immunization records), SchoolPad will process and store such data solely on behalf of the institution, and only as necessary to provide the agreed services. The institution is responsible for ensuring that such data is collected lawfully and with appropriate consent.
2.5 Data Protection Principles
- Purpose limitation – using data only for the purposes instructed by the institution;
- Data minimization – processing only the data required to deliver the service;
- Storage limitation – retaining data only for the period instructed or required by law;
- Lawful processing – ensuring all processing is consistent with applicable legal requirements.
2.6 Security Measures
- Hosting on Amazon Web Services (AWS) infrastructure with recognized security certifications;
- Encryption of data in transit by forcing HTTPS;
- Role-based access controls;
- Regular security audits and penetration testing;
- Data backup and disaster recovery measures, with backups retained for up to five days for recovery purposes.
2.7 Access Restrictions
Access to personal data within SchoolPad systems is limited to authorized personnel who require such access to perform their duties, in accordance with the instructions of the educational institution.
2.8 Data Centre Locations
SchoolPad’s infrastructure is hosted across geographically diverse data centres located in Mumbai, Singapore, the United States, and Canada (for institutes in Canada). Data related to Indian educational institutions is primarily stored in the Mumbai data centre, with other locations used for redundancy, disaster recovery, or specialized processing as instructed by the institution and in compliance with applicable law.
3. Data Retention and Deletion
3.1 In alignment with our Privacy Policy, in the event of termination of services between SchoolPad and an educational institution or User(s), we provide a clearly defined transition period of three months during which Users are strongly encouraged to download and preserve relevant data for future reference or transfer to alternative systems.
3.2 This three-month window begins from the effective date of service termination and is communicated clearly to all affected parties through multiple channels to ensure awareness of this important timeframe.
3.3 During this period, the data remains accessible through the Application's standard interfaces and can be exported into different formats depending on the nature of the information.
3.4 After the expiration of this stipulated transition period, SchoolPad irrevocably and permanently removes all associated user data from its active servers within 6 months of account termination, and data backups are purged within an additional 3-month cycle, in accordance with our commitment to data minimization and storage limitation principles.
3.5 Our deletion process ensures that no residual data remains within our systems beyond the specified retention period. Therefore, User(s) are responsible for downloading their data within the specified timeframe and SchoolPad shall not be liable for any data loss beyond the above-mentioned specific timeframe.
3.6 Data deletion extends to personal data including basic profile information, academic records, and/or any sensitive personal information.
3.7 Users of the Application have the ability to download their data in universally recognized, interoperable formats such as Excel spreadsheets and SQL files, depending on the specific data type and the legitimate technical requirements for its further use.
3.8 These export options are designed to ensure data portability and prevent vendor lock-in, allowing educational institutions and individuals to maintain ownership and control over their information even after their relationship with SchoolPad has concluded.
4. Third-Party Integrations
4.1 The Application integrates selected third-party services to enhance functionality and user experience in specific operational areas, like payment processing, communication, attendance and transport. These integrations include reputable payment gateways that facilitate secure financial transactions, GPS and Biometric Service Providers and established communication platforms providing SMS services and WhatsApp Business APIs that enable efficient notification delivery.
4.2 We engage third-party service providers that are established companies with a track record of reliability and industry presence. Before using such services, we review their publicly available terms of service and privacy policies to assess their stated security measures, compliance posture, and suitability for integration with our platform. Where a third-party service will be used to process or store data for a specific educational institution, we obtain the institution’s prior consent before enabling such use.
5. User Data Rights and Contact
5.1 Users have the right to access, correct, or request deletion of their personal data, and to withdraw consent where applicable under law. These rights are explained in our privacy notices and can be exercised by contacting the relevant educational institution, which acts as the Data Fiduciary.
5.2 SchoolPad, as a Data Processor, will support the institution in responding to such requests in accordance with applicable law and within a reasonable timeframe.
5.3 For questions, concerns, or complaints about privacy matters, Users may contact our Grievance Officer, Abhiraj Malhotra, at grievance@schoolpad.in or +91-9769660000. We aim to respond within 30 days and will keep Users informed if additional time is needed to address complex issues.
6. Consumer Protection and Transparency
6.1 We aim to acknowledge all user grievances within 48 hours of receipt through our official communication channels. Concerns may include technical issues, billing inquiries, data protection matters, or service functionality.
6.2 Payment options, applicable charges, refund procedures, and cancellation policies are determined by the educational institution and/or the payment service provider. SchoolPad does not set or control these terms but displays the payment gateway approved terms and conditions on the payment page for user reference.
6.3 All financial figures like fee amounts and related details are displayed as configured and instructed by the educational institution. In some cases, the institution may request that certain information be hidden from view. SchoolPad does not alter or verify these amounts or details, and their accuracy and completeness remain the responsibility of the institution.
7. User Responsibilities and Prohibited Activities
7.1 Users may use the Application only for legitimate academic and institutional management purposes that align with its intended functionality and comply with all applicable laws, regulations, and educational standards. Appropriate use includes accessing authorized information, communicating through approved channels, and engaging with features that support the educational mission of the affiliated institution.
7.2 Users must not upload, share, or distribute content that is false, misleading, harmful, offensive, defamatory, infringes intellectual property rights, violates privacy, promotes discrimination, harassment, or bullying, contains malicious software, depicts violence or illegal activities, or is otherwise unlawful.
7.3 Prohibited activities also include:
- Impersonating another person or entity;
- Distributing malware, viruses, or harmful code;
- Attempting unauthorized access to system areas or data;
- Extracting or copying large volumes of data beyond legitimate use;
- Engaging in denial-of-service (DoS) attacks or actions that compromise performance, integrity, or security of the Application.
7.4 Educational institutions are responsible for monitoring content created by their authorized personnel. Individual users are responsible for ensuring their own compliance with these standards.
7.5 Educational institutions must ensure that their authorized users follow secure account practices, including the use of strong and unique passwords, regular password changes, and enabling two-factor authentication (2FA) where available. Institutions should also promptly deactivate accounts that are no longer in use.
7.6 Violations may result in immediate suspension or termination of access, legal action, and reporting to relevant authorities.
7.7 Users must comply with all applicable legal requirements when using the Application, including but not limited to:
- The Information Technology Act, 2000;
- The Digital Personal Data Protection Act, 2023;
- The Consumer Protection (E-Commerce) Rules, 2020;
- The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
- Indian Intellectual Property laws, including the Copyright Act, 1957.
8. Legal Recognition of Electronic Transactions
8.1 All electronic records, communications, and digital signatures generated within the Application are legally recognized and enforceable under applicable laws, including the Information Technology Act, 2000, and its amendments. This includes, but is not limited to, records of attendance, fee payments, official communications, and other authorized transactions.
8.2 The Application maintains logs of significant transactions, subject to technical capabilities and legal requirements, to support system integrity and provide reference information for administrative purposes. These records are protected with security measures to preserve their integrity and authenticity.
8.3 SchoolPad may lawfully intercept, monitor, or record electronic communications within the platform, and retain relevant data, as required by law or where necessary to ensure system security, prevent unauthorized access, investigate potential violations, or comply with legal obligations. Such monitoring is conducted solely for legitimate purposes, in accordance with applicable laws, and with safeguards to minimize intrusion into user privacy.
8.4 Consent for data collection, processing, and disclosure within the Application is obtained by the educational institution, as the Data Fiduciary, in accordance with applicable laws. Where required, such consent must be explicit, informed, and obtained through clear affirmative actions. For minors, consent must be obtained from a parent or legal guardian.
8.5 SchoolPad, acting as a Data Processor, relies on the institution to ensure valid consent is in place. Users may withdraw consent at any time through the institution, and such withdrawal must be as straightforward as the process for granting consent.
9. Personal Data Breach Response
9.1 In the event of a personal data breach that may compromise the confidentiality, integrity, or availability of user information, SchoolPad will activate its incident response plan and work with the affected educational institution(s) to contain and mitigate the impact as quickly as possible, typically within 24–48 hours of detection.
9.2 As a Data Processor, SchoolPad will promptly inform the educational institution (Data Fiduciary) of the breach, providing available details so they can meet their legal obligations under the Digital Personal Data Protection Act, 2023, and other applicable laws. Where required, SchoolPad will support the institution in preparing notifications to affected individuals and the Data Protection Board of India.
9.3 Following initial containment, SchoolPad will conduct a detailed investigation and security review. Within 30 days of the incident, a report will be shared with the impacted institution(s) outlining:
- The nature and scope of the breach;
- Categories of data potentially affected;
- The number of users impacted (where known);
- Immediate corrective measures taken;
- Long-term preventive actions planned to strengthen security infrastructure.
10. Intellectual Property Rights
10.1 All content, features, functionality, design elements, and other intellectual property within the Application — including but not limited to text, graphics, logos, icons, images, audio, video, software code, user interface design, and their compilation — are the exclusive property of SchoolPad Technologies Private Limited or its licensors. They are protected under Indian copyright law, trademark law, and applicable international intellectual property treaties.
10.2 This protection applies to both published content and the underlying software components that power the Application.
10.3 SchoolPad’s name, logo, branding elements, and product names are registered or unregistered trademarks and may not be used without prior written consent.
10.4 Access to the Application grants Users only a limited, non-exclusive, non-transferable license to use it for its intended purposes under these Terms. It does not confer any ownership rights or permission to reproduce, distribute, modify, display, perform, create derivative works from, or otherwise exploit any proprietary content without written authorization.
10.5 Any reproduction, distribution, or use of the Application’s content for commercial purposes, educational resources, or personal use beyond normal platform operations is strictly prohibited without express prior written approval from SchoolPad Technologies.
10.6 Educational institutions using the platform retain ownership of their own uploaded content, branding, logos, and design elements, which may be used in line with their internal policies. This does not grant them any rights to SchoolPad’s proprietary materials.
10.7 The Application may include open-source components, which are governed by their respective open-source licenses. Copies of these licenses are available upon request.
10.8 SchoolPad respects the intellectual property rights of others and expects Users to do the same.
10.9 If you believe your intellectual property rights have been infringed by content on the Application, contact our designated intellectual property agent with full details of the alleged infringement. We will investigate and take appropriate action in line with applicable law.
10.10 Any violation of SchoolPad’s intellectual property rights may result in immediate suspension or termination of access, legal action under Indian law, and any other remedies available to us.
11. Account Security, Liability, and Indemnification
11.1 Account Security Responsibilities
Users are solely responsible for protecting the confidentiality of their account credentials (including usernames, passwords, security questions, and other authentication factors). Users should:
- Create strong, unique passwords;
- Enable two-factor authentication (2FA) where available;
- Avoid sharing account credentials;
- Refrain from accessing the Application over unsecured networks;
- Promptly update credentials if compromise is suspected.
11.2 Institutional Responsibilities
Educational institutions are responsible for managing access rights for their personnel and promptly deactivating or updating accounts when users leave, change roles, or no longer require access.
11.3 No Liability for User Negligence
SchoolPad is not liable for unauthorized account access, data breaches, or security incidents resulting from user negligence, weak passwords, credential sharing, or failure to follow recommended security practices.
11.4 Service Availability Disclaimer
The Application is provided on an “as-is” and “as-available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. While we aim for high availability and performance, we do not guarantee uninterrupted, timely, secure, or error-free service. Planned maintenance, technical issues, or events beyond our control may cause temporary service disruptions, and we will provide advance notice where feasible.
11.5 Limitation of Liability
- SchoolPad will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of revenue, profits, goodwill, data, or business opportunities, even if advised of the possibility of such damages.
- SchoolPad’s total aggregate liability for direct damages arising from any cause related to the Application, whether in contract, tort, or otherwise, will not exceed an amount equal to six (6) months of subscription fees actually paid by the institution to SchoolPad for the affected service.
11.6 Indemnification
Users agree to indemnify, defend, and hold harmless SchoolPad Technologies Private Limited, its directors, officers, employees, contractors, agents, subsidiaries, and affiliates from and against all claims, liabilities, damages, losses, costs, and legal fees arising from:
- Violations of these Terms or applicable laws while using the Application;
- Content uploaded or actions taken through user accounts;
- Infringement of intellectual property or other third-party rights;
- Activities that cause harm to others or expose SchoolPad to liability.
This indemnification obligation survives termination of the user’s relationship with SchoolPad.
12. Governing Law, Jurisdiction, and Amendments
12.1 SchoolPad may modify or amend these Terms of Use at any time to reflect changes in legal requirements, services, or business needs. While we may provide notice of significant changes via email or in-app notifications, it is the User’s responsibility to review the Terms periodically. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.
12.2 These Terms, and any dispute arising from or relating to them or the use of the Application, shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Indian Contract Act, 1872, and other applicable statutes, without regard to conflict of law principles.
12.3 All disputes shall be subject to the exclusive jurisdiction of the competent courts in Mohali, Punjab, and both parties irrevocably consent to such jurisdiction and venue, regardless of the User’s location or place of access.
